Immigration Law Overview

Making Sure of Your Rights Under U.S. Immigration Law

People coming to the U.S. tend to fall into one of two categories, based on intent: immigrants or nonimmigrants. Immigrants (including green card holders) are people who intend to live and work here indefinitely or permanently. Nonimmigrants are generally those who maintain a permanent residence in another country, whose presence in the U.S. will be temporary, and who intend to return home to their foreign residence at the end of their temporary stay.

Immigration issues can present expensive and time-consuming problems for both immigrants and nonimmigrants. Employers are often faced with inconvenient and confusing difficulties when petitioning for foreign national workers. Individuals, parents, and married couples often experience severe challenges when trying to achieve family unity. At the law firm of Philip Levin & Associates, we advise businesses and families in California and around the world about the most effective ways to overcome obstacles to their U.S. immigration objectives. Contact our office to learn more about the scope of our practice and our approach to client service.

A major goal of our firm is to serve California businesses by working with their in-house counsel or Human Resource departments on all immigration matters. To that end, our lawyers offer advice on such recurrent issues as:

  • Business immigration for nonimmigrant foreign nationals and those aspiring to green card status
  • Obtaining E-1 and E-2 visas for Treaty Traders and Treaty Investors
  • Obtaining H-1B visas for professional and technical employees in specialty occupations
  • Adjusting employment-based immigration status to permanent residence through the PERM labor certification process or for those who do not require a  labor certification through the petition process and/or national interest waiver application
  • Nonimmigrant employment visas of all kinds for professional, managerial, technical or semiskilled workers, as well as for researchers, artists, and athletes
  • Employers' immigration responsibilities involving record keeping and document retention, compliance audits and worksite enforcement

We also serve the needs of individuals and families through:

  • Immediate relative immigration based on marriage to a U.S. citizen
  • Other family-based visas, fiancé/fiancée visas, and relative immigration issues
  • Removal of the conditional basis of family's lawful permanent residence (green cards)
  • Preserving children's ability to immigrate with their family even if they are reaching the age of 21
  • Avoiding and resolving problems related to immigration through marriage such as preparing and filing hardship waivers
  • Advice and representation on deportation, removal and asylum issues
  • Representation of lawful permanent residents (green card holders) in the naturalization process to become U.S. citizens as soon as possible

While the primary focus of our work is to avoid adversary proceedings by correctly assessing and documenting your situation, the firm also represents clients throughout the full range of immigration hearings and appeals held before the U.S. Immigration and Federal Courts.
